Terms of Service Definitions
We use the following definitions, unless other specified below, throughout these Terms of Service: -

1. Web Sites – this refers to all of the Web Sites and Web Pages that Genesis Natural Healing own and run to provide the Products and Services offered;

2. Products – this refers to all of the Products, including third-party Products, that Genesis Natural Healing Offers – this will include, but is not limited to the Health Plans, Schedules and Supplements;

3. Services – this refers to all Subscription and Non-Subscription Services that Genesis Natural Healing offers;

4. Apps – this refers to all Web Sites, Services, Plans, Schedules and Products owned by Genesis Natural Healing, as well as our mobile device application for the iPhone, tablets and android devices.

 
Terms of Service Rights
This sentence and the following sections of these Terms of Service will survive the expiration or termination of these Terms of Service for any reason whatsoever. These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by You, but may be assigned by Genesis Natural Healing without restriction.
 
General
You agree that;
Our Web Sites shall be deemed passive Web Sites that does not give rise to personal jurisdiction over Genesis Natural Healing, either specific or general. Those who chose to access the Web Sites or the Services from other locations do so upon their own initiative and are responsible for compliance with all applicable local laws.

You expressly agree that the laws of the United Kingdom, excluding its or any other jurisdictions conflicts of law rules, shall govern these Terms of Service and Privacy Policy, and that exclusive jurisdiction for any claim or dispute with Genesis Natural Healing or any of our partners relating in any way to Your use of the Web Sites or the Services resides in the courts of the United Kingdom, and You further agree and expressly consent to the exercise of personal jurisdiction in the courts of the United Kingdom in connection with any such dispute. You agree that, regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Web Site or the Services or these Terms of Service must be filed within no longer than one (1) year after such claim or cause of action arose or be forever barred.
The section titles in these Terms of Service are for convenience only and have no legal or contractual effect.
 
Age Restrictions and Contradictions
All users who register to use and follow our Products must be of 18 years old or greater.
There are also other contradictions for following our Products, and a full list of these are available from us by contacting us as they do change from time-to-time. Please request this list before purchasing our Products or Services.

Users under the age of 18 years old can subscribe to the Services but they must have the permission of their parents or guardian beforehand. Payment for such Services must also be approved by their parent or guardian and paid by them accordingly.
 
User Provided Content and Communication
Any information or material submitted or sent to Genesis Natural Healing or otherwise via the Web Sites or Services will be deemed to be confidential. We will store the information confidentially and it will not be shared with any other third-party without Your prior permission.
However, You do warrant and agree that we can use all such information submitted by You, including but not limited to; personal, questionnaire, emails and testimonials on our Web Sites or for purposes of marketing or advertising, including research and trails. However, You will have the option to make this anonymous and if You select this option on your personal account page on our Web Sites, we will not use Your full name meaning You cannot be identified by anyone externally.

Notwithstanding the above clause, by submitting or sending information or other material to Genesis Natural Healing or otherwise via the Services and Web Sites You represent and warrant that the information is original to You and that no other party has any rights to such information or material. All submitted content may be edited for any purpose by Genesis Natural Healing.

By using our Plans, Service or communicating with Genesis Natural Healing, including by means of submitting or sending Content or other information or material to or via our Services or Web Sites, You grant Genesis Natural Healing a royalty-free, unrestricted, worldwide, perpetual, irrevocable, non-exclusive and fully sub-licensable right and license to use and exploit such Content, information or material, in any form, media or technology not known or later developed. For clarity, and without derogating from the generality of the previous sentence, by posting Content, including but not limited to; written text, images, audio files and moving pictures, to the Service or Web Sites, You agree to the publication of such Content, or excerpts thereof, on the Services, the Web Site and in any other media, including but not limited to other Web Sites, books, brochures, DVD’s, films, marketing, advertising that are produced by Genesis Natural Healing or any of its affiliates or subsidiaries (subject to Your Anonymous setting). No compensation for any such reproduction of content is owned unless specifically agreed to be Genesis Natural Healing in writing beforehand. All submitted Content may be edited for any purpose by Genesis Natural Healing.

By submitting any Content to the Service or Web Sites, You warrant that You have permission from all persons appearing in Your media to submit such Content, and grant the rights, described herein. Never post a picture or video of or with someone unless You have their explicit permission.
It is strictly prohibited to submit media of any kind that contain expression of hate, abuse, offensive language/images or conduct, obscenity, pornography, sexually explicit or any material, behaviour or conduct that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms of Service, Privacy Policy or any other of our other policies posted on the Web Site or through our Service.
If You submit any business information, idea, concept or invention to Genesis Natural Healing by email, via the Services, secure messaging or otherwise through the Web Sites, You automatically grant (or warrant that the owner of such Content or intellectual property has expressly granted Genesis Natural Healing) a royalty-free, perpetual, irrevocable, worldwide, sub-licensable, non-exclusive license to use, reproduce, create derivative works from, modify, publish, edit, translate, distribute, perform and display such Content or intellectual property in any media or medium, or any form, format or forum now known or hereafter developed. If You wish to keep any business information, idea, concept or invention private or propriety, do not submit them to Genesis Natural Healing.
 
Links
You may be able to link to third-party Web Sites, Content, text, images, video or any other media type (collectively called “Links”) from our Web Sites or Services. We are not responsible for the Content, availability, advertising, products or any other material contained on the third-party Links, or any additional links contained therein. These links do not imply any endorsement by, or association with Genesis Natural Healing in any way.
In no event shall we be liable, directly or indirectly, to anyone for any loss or damage arising from or occasioned by the creation or use of the Links or the information or material accessed through such Links. We reserve the exclusive rights, at its sole discretion, to add, change, decline or remove, without notice, any Links. All title and intellectual property rights in and to the content of the Links is the property of the respective content owner and may be protected by applicable intellectual property laws.

AS WE HAVE NOT CREATED THE LINKS, WE CANNOT GUARENTTEE THAT THE LINKS WILL NOT CONTAIN SEXUALLY EXPLICIT, OFFENSIVE OR OTHERWISE MATERIAL WITHOUT OUR KNOWLEDGE. IF YOU CLICK ON ANY LINKS, YOU ASSERT THAT YOU ARE OF LEGAL ADULT AGE IN YOUR JURISDICTION TO VIEW SUCH MATERIALS AND THAT THE VIEWING, READING AND/OR DOWNLOADING OF CONTENT FROM THESE LINKS DOES NOT VIOLATE THE STANDARDS OF THE COMMUNITY TO WHICH YOU BELONG AND/OR FROM WHICH YOU ACCESS THESE LINKS.
IF YOU COME ACROSS SUCH EXPLICIT LINKS, INFORM GENESIS NATURAL HEALING IMMEDIATLY AND WE WILL REMOVE ACCESS TO THE LINKS AND STOP USING THE THIRD-PARTY CONTENT PROVIDER IMMEDIATELY.
 
Promotions
From time-to-time, we may offer contests, giveaways, promotions, games or offers (collectively called “Promotions”) as part of the Services and Web Sites.
Participation in any Promotions shall be subject to the rules published by Genesis Natural Healing with regard thereto, and You agree to release Genesis Natural Healing and our affiliates, agents, advertisers, sponsors and promotional partners from all liability arising from participation in any Promotions located on, or accessed through our Web Site or Services, including third-party Links. Some promotions may add prizes or further offers to participants; all such prizes or offers are subject to the rules of such Promotions. We reserve the right to cancel, terminate or alter any Promotions or the rules thereof at any time without prior notice, including before the Promotions finishes.
 
Commercial Transactions
Certain products may be offered for sale directly or via third-parties, via our Web Sites and Services. In the event You wish to purchase any of these products, You will be asked by the Web Site or an authorised third-party to supply certain information to fulfil the order, including but not limited to; Your full name, address, telephone number and credit/debit card information. You agree to provide the Web Sites or such third-party with the foregoing information as well as any other mandatory information that is accurate, complete and current, and to comply with the terms and conditions of any agreement that You may enter into governing Your purchase. You shall be responsible for all charges incurred through Your account as well as paying all applicable taxes. We will not be liable for any personal damage or loss to You for such transactions.

All purchases of products on or via the Services must be made by adults 18 years of age or older, or as mandated within Your location, country or territory.
 
Intellectual Property Rights
We (including but not limited to; all of our companies, Web Sites and brand names and associated logos, page headers, custom graphics, icons, plans, schedules) on the Web Sites and Service are trademarks and/or Service marks owned by Genesis Natural Healing. All other trademarks, product names and company names and logos appearing on our Web Sites and Service are the property of their respective owners.
The Service contains information, data, software, photographs, graphics, videos, text, images, typeface, sounds and other material (collectively called “Content”) that are protected by copyrights, trademarks or other proprietary rights, and these rights are valid and protected in all forms, media and technologies existing now or developed in the future. All Content is copyrighted as a collective work under the United Kingdom copyright laws, and we own a copyright in the selection, coordination, arrangement and enhancement of such Content.

You may not modify, remove, delete, augment, add to, publish, transmit, share, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. All rights to such Content are reserved to their respective copyright owners. Permission is granted to electronically copy and print in hard copy portions of the Web Sites, and/or Services and/or Products solely for non-commercial, personal purposes. You are prohibited from sharing such with any other person. Except as provided in the preceding sentence or as permitted by the fair use privilege under the United States and other countries copyright laws, You may not upload, post, reproduce or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other proprietary right. Any other use of the Content, including reproduction for purposes other than as noted above, modification, distribution, replication, commercial or other use, without our prior written permission, is strictly prohibited. If You violate any of these terms, your permission to use the Content will automatically terminate and You must immediately destroy any copies You have of any portion of the Content. Failure to comply could result in legal proceeding against you.
 
Copyright Notice and Takedown Procedures
If You are a copyright owner or an agent thereof and believe that any Content on the Product and/or Service infringes upon Your copyright, You may submit a notification to our Copyright Agent (email from our Web Site) with the following information in writing: -

General Disclaimer
The Web Sites, Products and Services are provided “as is”, “where is” and “as available”, without warranty of any kind, either express or implied. We expressly disclaim any and all warrants, including, but not limited to;

1. Warranties concerning availability, accuracy, appropriateness, reliability, timeliness, usefulness or otherwise of the Content on the Web Sites, Products or the Services; and

2. Warranties of title, non-infringement, merchantability or fitness for a particular purpose. This disclaimer applies to any damages, loss, death, injury, illness, disease, worsening symptoms, new symptoms arising, lack of improvement or cure, or similar caused by the Web Sites, the Service or Products, including without limitation, as a result of;

   • Any error, omission or defect in the Content, Services, Plans or Schedules; or

   • Any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorised access to, alteration of, or use of record, whether for breach of contract, tort, negligence, defamation or under any other cause of action.

3. We do not warrant or guarantee;

   • That any portion of the Web Sites or Services will be free of infection by viruses, worms, Trojan horses or anything else manifesting contaminating or destructive properties, or

   • That access to the Services will be uninterrupted or error-free.

 
Limitation of Liability
In no event will Genesis Natural Healing, our affiliated entities, our partners or their respective officers, shareholders, directors, managers, employees, contractors, consultants, sub-contractors, agents, sponsors, successors or assigns (collectively called “Parties”) be liable to any party for;

1. Any direct, special, punitive, incidental or consequential damages or any other damages arising in any way out of the availability, use, reliance on, or inability to use the Web Site, Products, Plans, Schedules or Services, even if we or our agents shall have advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort or otherwise;

2. Any claim attributable to errors, omissions or other inaccuracies in, or destructive properties of, the Web Sites, Products, Plans, Schedules or Services;

3. Personal injury or death caused by Your use or misuse of the Products, Services, Web Sites, Plans or Schedules;

4. Statements or conduct of any third-party on or via the Web Sites, Products, Plans, Schedules or Services; or

5. Unauthorised access to or alteration of Your transmissions, personal information or data.

 
As some territories or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, the liability of Genesis Natural Healing and our parties shall be limited to the maximum extent permitted by law.
Notwithstanding the above, we and our party’s aggregate sole liability for any reason to You, and Your sole and exclusive remedy for any cause or claim whatsoever relating to the Web Sites, Products, Services, Plans or Schedules, shall be limited to the extent of actual damages incurred by You, not to exceed GBP £300.
 
Indemnification
You agree to defend, indemnify and hold harmless, Genesis Natural Healing, our affiliates, officers, shareholders, directors, consultants, contractors and employees from any and all claims, liabilities, costs and expenses, including attorney/legal fees/medical/health costs, arising from or in connection with;

1. Your use or misuse of the Web Sites, Products, Services, Plans and Schedules;

2. The distribution or transmission of any Content or other materials by You or users authorised by You; or

3. Any violation of these Terms of Service by You. We reserve the right to assume the exclusive defence and control of any matter subject to such indemnification and You hereby agree to cooperate with Genesis Natural Healing in asserting any available defences.

 
Termination and Survival of Certain Provisions
These Terms of Service are effective until terminated by You or Genesis Natural Healing. If You no longer agree to be bound by these Terms of Service, You must immediately cease Your use of the Products, Plans, Schedules and Unsubscribe from the Services via Your person account page on the Web Sites. Failure of You to Unsubscribe will mean we will continue to collect Your subscription fee on a monthly recurring basis until You do Unsubscribe. We cannot refund any Subscription Service fees already taken so please make sure You Unsubscribe as soon as You do not wish to continue using the Service. It is solely and unquestionably Your responsibility to stop single and recurring payments from your bank account to Genesis Natural Healing before they leave your bank. Genesis Natural Healing cannot be held responsible, liable or accountable for any such payments where You have failed to Unsubscribe.

Subject to applicable law, we reserve the right to suspend or deny, in its sole discretion, Your access to all or parts of the Web Site and/or Service with or without notice. You acknowledge and agree that We may immediately deactivate or delete Your account and all related information and files in Your account and bar any further access to such files, the Web Site, Products or the Services. Further, You agree that we and our affiliated entities shall not be liable to You or any third-party for any termination of Your access to the Web Sites, Products or the Services.
 
Warning / Disclaimer / Liability
Each and every one of our Services, Products and Health Plans contains the warnings, disclaimer and limited liability statements below.
These statements are very important and by accepting these Terms of Service and associated Privacy Policy, You are also agreeing to all of the following statements. We have also repeated these statements at the beginning of each and every plan, so please make sure You have read and understood them, and that You are in complete agreement with and acceptance of before You commence the Schedules contained within the Plans or use our Subscription Services.

1. You are agreeing to follow our Plans and Schedules completely of Your own accord. Please make sure You have read and understood these before You start the Plan.

   • You are agreeing that we cannot be held liable, accountable or responsible for any adverse effect from following our Plans or from information on our Web Sites;

   • By following our Plans and Schedules, You are once again confirming that You agree with the above;

   • Importantly, if You do not agree with any of the above or You have not signed the Terms of Service and Privacy Policy at point of purchase, then please do not follow our Plan or Schedules;

2. Please let Your family, friends, doctor, healthcare professional and others close to You know that You are following our Plans – ask them to keep an eye on You, contact You daily to make sure all is well, how You are progressing, etc;

3. You confirm that You do not have any of the contradictions to following our Plans as available from us via contacting us from our Web Sites – please request this again as it does change from time-to-time;

4. If You are currently receiving medical care or treatments of any kind, or You are on any medication for Your health conditions as prescribed to You by Your doctor or healthcare professional, please do not just stop this medication on Your own. Consult with Your doctor or healthcare professional beforehand;

5. Please inform Your doctor or healthcare professional that You are following this Plan, and work with them, especially on managing Your medication and treatment as You may need to adjust or even stop Your medication but do so in conjunction with Your doctor or healthcare professional at the right time and please take their advice;

6. Please continue with any prescribed or recommended supplementation from Your doctor or healthcare professional. For example, if they have prescribed or recommended a certain supplement and amount to take, then continue with their recommendations;

7. Do not adjust or stop Your medication Yourself, this is very important;

8. Please do not share these Plans with anyone else for the following reasons: -

   • It is illegal and against copyright law to share these Plans with someone else, as the Plans have been purchased by You alone and it should not be shared with anyone;

   • The person would not have signed our Terms of Service and Privacy Policy; nor would they have completed our questionnaire;

   • The person will not get any support from Genesis Natural Healing as we will not know anything about them;

9. All information in this Plan is based on research completed by other third-parties but the authors are not engaged in providing medical diagnosis, treatment or advice to individuals. The information in these Plans are no substitute for professional medical advice and if You are suffering with any health conditions, seek professional medical advice before embarking on these Plans. Genesis Natural Healing cannot accept any liability for loss, injury, death or damage which is sustained by individuals following our Plans or Services in consequence of adopting any suggestions or of using the information in these Plans, on our Web Sites or from our Subscription Services.
